ASAP PUBLIC ADJUSTING, INC operates strictly on a contingency fee basis. Clients do not pay an upfront public adjusting fee. Any fee is earned and calculated only as stated in the signed public adjuster contract and as permitted by Florida law.
No Upfront Costs and Refunds
Because no public adjusting fee is collected upfront, there is ordinarily no prepaid professional fee to refund. If money is ever received that is not earned or is required by law or contract to be returned, it will be handled in accordance with the applicable contract and Florida law.
Florida Cancellation Rights
The following summary reflects the consumer cancellation provisions generally described in section 626.854, Florida Statutes.
Florida law generally permits an insured or claimant to cancel a public adjuster contract without penalty or obligation within 10 days after the date the contract is executed. A contract entered into based on events declared a state of emergency by the Governor may generally be canceled without penalty or obligation within 30 days after the date of loss or 10 days after the contract is executed, whichever is longer.
An insured may also cancel without additional penalties or fees if the public adjuster does not provide the insured and insurer with a written estimate within 60 days after the contract is executed, unless the delay results from factors beyond the public adjuster’s control. The right ends when the required written estimate is provided.
After the applicable statutory cancellation period, the client may still cancel the contract as provided by Florida law and the signed agreement. Depending on the timing and circumstances, the public adjuster may be entitled to payment for reasonable and necessary emergency out-of-pocket expenses or compensation for services performed, but only to the extent permitted by law and the contract.
Provide written notice to ASAP PUBLIC ADJUSTING, INC and send it by certified mail, return receipt requested, or another form of mailing that provides proof, to 17350 NE 12th Ct, Miami, FL 33162. Include your name, property address, claim number if available, and a clear statement that you are canceling the public adjuster contract. A courtesy copy may also be sent to shmuel@asapadjusters.com.
